CurbMerge Privacy Policy
This Privacy Policy explains how CurbMerge is operated by Passion Projects Unlimited LLC, a New Jersey limited liability company ("Passion Projects Unlimited," "CurbMerge," "we," "us," or "our"), and how we collect, use, share, and protect information in connection with the CurbMerge mobile application and the curbmerge.com website (together, the "Service"). CurbMerge is a coordination platform that helps drivers voluntarily communicate about the availability of legally occupied public parking spaces. CurbMerge does not reserve, sell, guarantee, assign, or control any public parking space. The Service is publicly available through Apple’s App Store and operates in the service areas identified within the app, which may be expanded or adjusted over time. By using the Service, you agree to the collection and use of information as described in this Policy.
1. Information We Collect
Device-Linked Profile Information
When you first use CurbMerge, the app creates a CurbMerge-generated device-linked user identifier for the operational purposes of supporting handoffs, acknowledgment records, and reliability information. CurbMerge does not require your name, email address, password, home address, phone number, or government-issued identification to use the app. You use the Service through a device-linked pseudonymous profile without providing your legal identity or direct contact information. If you contact us for support, submit a privacy request, or otherwise communicate with us, we collect the contact information and contents of the communication that you choose to provide.
Location Data
CurbMerge’s core function depends on precise GPS location data. When you actively use the Service, we collect your device’s precise location to show nearby handoff opportunities, place offered curb spots accurately, connect a Giver with a nearby Receiver, display location information during an active matched handoff, and open Apple Maps navigation to a claimed opportunity. Location data is collected only while the app is in active use. CurbMerge does not continuously collect precise location while the app is operating in the background. If a future version of the Service uses weather conditions associated with your location (for example, to calculate a "Curb Pressure" indicator), this Policy will be updated before that feature is enabled.
Distribution Through the App Store
The Service is distributed through Apple’s App Store and relies on Apple Maps for navigation. Apple may separately collect information about your download and use of the app and your use of Apple Maps under its own privacy terms, which are not controlled by CurbMerge. You can review and control location permissions for the Service at any time through iOS Settings.
Device Identifier and Technical Information
We collect certain technical information automatically, including device type, operating system, a CurbMerge-generated device-linked user identifier, IP address, app version, and technical request or feature-interaction data necessary to operate, secure, troubleshoot, and improve the Service. We may receive crash or diagnostic information from Apple when a user has chosen to share that information with app developers through Apple’s settings. CurbMerge does not currently integrate a third-party advertising or behavioral analytics software development kit, and it does not collect an advertising identifier for targeted advertising or cross-app tracking.
Handoff and Reliability Data
We collect information about handoff requests, confirmations, cancellations, and completions, and we use this information to generate a reliability metric for the individual user, tabulated from the number of successful handoffs associated with that user’s device-linked profile. The reliability metric is displayed to that individual user and is not displayed to other users. The Service is designed so that, during an active, matched handoff, status information and live location where enabled are shared only with the two matched users and not with other nearby users, and so that this sharing stops once the handoff completes, is cancelled, or expires. An unsuccessful, cancelled, or expired handoff is recorded and described neutrally; it is not displayed as a penalty or a negative label. If a completed handoff triggers a "Promises Kept" confirmation or aggregated community-impact statistics (sometimes referred to as "Neighborhood Pulse"), those statistics are estimates presented at the individual or aggregated community level and are not currency, compensation, or a redeemable reward.
Website Technical Information
The curbmerge.com website does not currently use advertising cookies or third-party behavioral analytics tags. Our hosting infrastructure may automatically process standard server-log information, such as IP address, browser type, access time, and requested page, to deliver, secure, maintain, and troubleshoot the website. If we later introduce cookies or analytics technologies that materially change our information practices, we will update this Policy and provide any notice or choice required by law before those practices begin.
2. How We Use Information
- To operate the core handoff-coordination function of the Service, including matching a Giver’s departure with a nearby Receiver’s request.
- To calculate and display reliability or reputation metrics to the individual user based on that user’s completed handoffs.
- To maintain, secure, debug, and improve the Service, including diagnosing technical issues.
- To communicate with you about the Service, including service-related notices.
- To comply with legal obligations and to enforce our Terms of Service.
- In aggregated or de-identified form, to analyze parking-coordination patterns; any such aggregated data will not identify you individually.
3. Sharing of Information
We do not sell personal information or share personal information for targeted advertising. We share information only as follows:
- With nearby users, the location and status of an offered curb handoff opportunity as necessary to allow the opportunity to be discovered and claimed. During an active matched handoff, additional handoff status information and live location, where enabled, are shared only with the two matched users.
- With service providers who help us operate the Service, such as Apple for App Store distribution, Apple Maps navigation, and optional Apple-provided diagnostics, and hosting or infrastructure providers. Any service provider that receives user information is required to protect it consistently with this Policy and applicable law and may use it only to provide services to CurbMerge.
- If we determine in good faith that disclosure is required to comply with a legal obligation, protect the rights or safety of CurbMerge, our users, or the public, or investigate fraud or misuse of the Service. CurbMerge does not claim to be able to protect your information against lawfully issued legal process.
- In connection with a merger, acquisition, financing, or sale of assets, subject to the receiving party’s agreement to honor the commitments in this Policy.
If, in the future, CurbMerge shares aggregated or de-identified location analytics with a third party for compensation, we will update this Policy before doing so and, where required by law, will provide an opt-out.
4. Data Retention and Deletion
We retain the CurbMerge-generated device-linked user identifier, acknowledgment records, handoff records, reliability data, and related technical records for as long as reasonably necessary to operate, secure, troubleshoot, and improve the Service; enforce our Terms of Service; prevent fraud or misuse; resolve disputes; and comply with legal obligations. Handoff records may retain the coordinates of an offered or claimed curb location and related event timestamps. During an active matched handoff, the app transmits the user’s current live location for coordination, and the most recent live-location value replaces the prior live-location value rather than creating a separate chronological trail of successive location updates. Live-location updating and sharing stop when the handoff completes, is cancelled, or expires. CurbMerge does not continuously collect precise location while the app operates in the background and does not maintain a continuous movement history. Deleting the CurbMerge app removes locally stored app data from that device but does not automatically delete information previously transmitted to CurbMerge. You may request deletion of your device-linked profile and associated personal information by contacting us using the information in Section 8. When possible, submit the request before deleting the app and include the device-linked identifier or other information available in the app that will help us locate the relevant records. We will honor verified deletion requests except where we are permitted or required to retain limited information, including records needed to investigate fraud or misuse, resolve disputes, protect legal rights, or comply with legal obligations.
5. Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, or obtain a portable copy of your personal information, and to opt out of certain uses of your information, including targeted advertising, the sale of personal information, or profiling that produces legal or similarly significant effects. This includes rights available to New Jersey residents under the New Jersey Data Privacy Act and rights available to residents of other states with comprehensive privacy laws (including California, Colorado, Connecticut, Virginia, and Utah, among others), to the extent those laws apply to CurbMerge. To exercise any of these rights, contact us using the information in Section 8. We will not discriminate against you for exercising a privacy right. Where required, we will honor recognized universal opt-out signals such as the Global Privacy Control.
6. Children’s Privacy
The Service is intended for adults. You must be at least 18 years of age to use the Service, as described in our Terms of Service. CurbMerge is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly. A parent or guardian who believes we may have collected information from a child may contact us using the information in Section 8.
7. Security Measures
We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, or disclosure, including encryption of data in transit, access controls limiting who may view user information, and routine review of our security practices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Contact Us
Questions about this Privacy Policy, requests to exercise a privacy right, and appeals of decisions concerning a privacy request may be submitted by email to support@curbmerge.com or through the support information available within the CurbMerge app and at curbmerge.com.
9. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means before the change takes effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Policy.
